Peace Corps will be settling the [http://www.peacecorpswiki.org/images/Ludlam_Hirschoff_FOIA_Lawsuit_2011.pdf lawsuit] regarding production of the

country-by-country Volunteer surveys. The Peace Corps has apparently
+
been told by the Department of Justice that it won't defend the Peace
+
Corps' denial of the Ludlam FOIA request for those surveys. One of the
+
key issues there is that the Peace Corps had previously found that the
+
surveys were FOIAable and then reversed itself. That's the same
+
situation with the Medical Screening Guidelines. I, therefore, renew
+
my appeal for the guidelines.

This is in response to your Freedom of Information Act (FOIA) appeal. You are appealing the determination made by the FOIA Officer in response to FOIA request number 11-114. Specifically, you are appealing the decision because it is "in consistent with the previous decision to release the documents to me at a set price. See FOIA #05-104."The Agency is under no obligation to release the current Medical Screening Guide lines based on previous releases or potential releases of similar information. The Medical Screening Guidelines have been modified several times since 2005. Accordingly, I am upholding the determination made by the FOIA Officer and denying your appeal. The Medical Screening Guidelines are used solely internally at Peace Corps and was properly withheld pursuant to 5 U.S.C. § 552(b)(2). Exemption 2 exempts from mandatory disclosure records related solely to the internal personnel rules and practices of an agency.This is the final decision of the Peace Corps on this FOIA appeal. If you disagree with this decision, you may seek judicial review in accordance with 5 U.S.C. § 552(a)(4).
